Rationale & context
2015 PSE at La Halle, main subsidiary of Vivarte group (French no.1 in shoes and mass-market textile). 1,476 net positions cut. Context: collapse of French 'low-cost textile' model facing Asian competition (Primark, H&M) and e-commerce (Vente-privée, ASOS). Vivarte revenue 2015-2016: €2.2B with 8% decline. Supplementary indemnity negotiated by unions in an innovative hybrid format: 1/2 month of salary OR €1,000 per year of seniority (most favorable to employee). This format became a reference in French textile retail. Aftermath: progressive Vivarte group dismantling from 2017 (André, Naf Naf, Kookaï sales) then new La Halle aux chaussures PSE wave in 2017 (~450 jobs, 141 stores closed).

What employees received — legal base, supra-legal, caps
Legal / collective indemnity
This is the minimum guaranteed by your sector's collective agreement. Paid to every affected employee on top of the statutory legal indemnity.
Apparel Retail collective indemnity
Underlying formula ·
Supra-legal top-up
The amount negotiated by unions ON TOP OF the legal and collective minimum. Often the largest part of the package.
**1/2 month of salary OR €1,000 per year of seniority** — most favorable to the employee is applied. Became benchmark for French textile retail.
Notice period
Period between the dismissal notification and the actual departure. The employee remains paid during this time, whether they work or not.
Not specified in the PSE.
Collective minimum · Apparel retail agreement (IDCC 1483) — Employees: 1 month. Supervisors: 2 months. Managers: 3 months.
Example — rough estimate
For a non-manager employee with 5 years of seniority and €3,500 gross/month:
Collective severance(1.25 months × €3,500)€4,375
Supra-legal severance(2.5 months × €3,500)€8,750
Estimated gross total€13,125

Very rough illustrative estimate. Your actual amount depends on your exact reference salary (max of 1/12 of last 12 months or 1/3 of last 3 months, bonuses included — art. R1234-4 French Labour Code), your precise status (manager/non-manager/ETAM), your hire date and your individual situation. For a personalized calculation of the legal indemnity, use the official French Ministry of Labour simulator.
